FIGHTING FOR WALMART TRUCK ACCIDENT VICTIMS

Walmart’s trucking fleet is one of the largest on American roadways. It maintains its own trucking workforce of 9,000 drivers, which is unusual for major retailers. The median salary for Walmart truckers is double that of the national median, which contributes to a more highly-skilled fleet. And that has translated to an impressive safety record.

But with more than 6,000 tractors and 60,000 trailers on the road, accidents do happen. And Walmart has proven that they will go to the mat on commercial personal injury cases, even when their drivers are clearly in the wrong.

Commercial Truck Accidents

When a truck accident occurs, it is often devasting. Trucks can weigh up to 80,000 pounds — 20 times more than the average sedan! Although commercial trucks only make up about 5 percent of the vehicles on American roads, they account for 11 percent of vehicle fatalities.

Truck accidents can be life-altering, and trucks that belong to Walmart’s large fleet have an equally large legal team on their side. Get your own expert legal assistance by reaching out to Richard Hollawell and Associates today!

Tracy Morgan’s Coma-Inducing Run-In with Walmart

Before a Walmart driver plowed into 30 Rock star Tracy Morgan’s limousine van in 2014, the driver had already driven 700 miles and been awake for 24 hours. The accident left Morgan’s friend dead and Morgan in an eight-day coma.

Walmart’s defense still found room to question Morgan’s celebrity car accident lawsuit. Their legal team tried to assuage their responsibility by claiming these injuries “were caused, in whole or in part, by plaintiffs’ failure to properly wear an appropriate available seatbelt restraint device.”

If Walmart can deny responsibility for such a seemingly open-and-shut case, what will they do in lawsuits with non-celebrities?

The Challenges of Suing a Large Corporation Like Walmart

A common impression of corporate liability is that big companies like Walmart are well-insured. However, Walmart is such a large company that it has the means to be self-insured — although it did manage to recoup much of the reported $90 million that Morgan received in his settlement.

When you sue any large corporation, you’ll have to deal with the standard tactics they employ. These can include:

  • Strategic delays, meant to increase likelihood of accepting a below-market settlement
  • Counter claims and affirmative defenses like the one that ascribed blame to Morgan
  • Questioning the severity of injuries and resultant damages
